Drug Use and Criminal History Guidelines for Admission

  • Class B Misdemeanor: No person shall be allowed to attend the Peace Officer Training Program who has been convicted of a Class B Misdemeanor within the past 3 years regardless of the status of any deferred imposition of sentence or post-conviction reduction. (This includes criminal traffic violations such as DUI, Driving Under Suspension, No Liability Insurance, Reckless Driving, etc.)
    • Minor In Possession/Consumption of Alcohol: No person shall be allowed to attend the Peace Officer Training Program if they have, post-high school-as an adult, been convicted for minor in possession or consumption of alcohol within the past 2 years regardless as to the status of any deferred imposition of sentence or post-conviction reduction.
    • Marijuana Use: No person shall be allowed to attend the Peace Officer Training Program if they have used marijuana within the past 2 years.
    • Domestic Violence: No person shall be allowed to attend the Peace Officer Training Program who has ever been convicted of a crime involving domestic violence, regardless of the status of any deferred imposition of sentence or post-conviction reduction.
  • Class A Misdemeanor: No person shall be allowed to attend the Peace Officer Training Program who has been convicted of a Class A Misdemeanor within the past 5 years regardless of the status of any deferred imposition of sentence or post-conviction reduction.
    • Class A Misdemeanor Involving Violence or Intimidation: No person shall be allowed to attend the Peace Officer Training Program if they have ever been convicted of a Class A Misdemeanor involving violence or intimidation if the crime was committed while using or possessing a firearm or dangerous weapon regardless as to the status of any deferred imposition of sentence or post-conviction reduction.
    • Possession of Marijuana Drug Paraphernalia: No person shall be allowed to attend the Peace Officer Training program if they have been in possession of marijuana drug paraphernalia, the possession of which would constitute a Class A Misdemeanor, within the past 3 years.
  • Felony Conviction: No person shall be allowed to attend the Peace Officer Training Program who has ever been convicted anywhere of a felony. This includes those instances where a person received a deferred imposition of sentence or where there was a post-conviction reduction in the level of offense.
    • Hard Drug Use: No person shall be allowed to attend the Peace Officer Training Program if they have used or possessed any illegal “hard” drug, the possession (or consumption) of which would constitute a felony under ND Law if such use occurred post high school-as an adult within the past 7 years.
