Drug Use & Criminal History Guidelines for Admission (POT)

  • Class B Misdemeanor: Anyone convicted of a Class B Misdemeanor in the past 3 years is prohibited. This rule applies regardless of any deferred sentence or post-conviction reduction. It includes criminal traffic violations such as DUI, driving under suspension, no liability insurance, reckless driving, and similar offenses.
    • Minor In Possession/Consumption of Alcohol: Anyone convicted, after high school of minor in possession or consumption is prohibited. This applies only to convictions within the past 2 years, regardless of any deferred imposition of sentence or post-conviction reduction.
    • Marijuana Use: Anyone who has used marijuana within the past 2 years is prohibited.
    • Domestic Violence: Anyone ever convicted of a crime involving domestic violence is prohibited. This rule applies regardless of any deferred imposition of sentence or post-conviction reduction.
       
  • Class A Misdemeanor: Anyone convicted of a Class A Misdemeanor within the past 5 years is prohibited. This rule applies regardless of any deferred imposition of sentence or post-conviction reduction.
    • Class A Misdemeanor Involving Violence or Intimidation: Anyone convicted of a Class A Misdemeanor involving violence or intimidation is prohibited. This includes crimes committed while using or possessing a firearm or dangerous weapon. The rule applies regardless of any deferred imposition of sentence or post-conviction reduction.
    • Possession of Marijuana Drug Paraphernalia: Anyone who possessed marijuana paraphernalia, a Class A Misdemeanor, within the past 3 years is prohibited.
       
  • Felony Conviction: Anyone convicted of a felony, including cases with a deferred imposition of sentence or post-conviction reduction, is prohibited.
    • Hard Drug Use: Anyone who has used or possessed any illegal “hard” drug that would constitute a felony under ND law, as an adult within the past 7 years, is prohibited.
